Gold and Silver are exempt from sales tax in the state of Arizona
- The legal exemption for the sale of precious-metal bullion and “monetized bullion” (i.e. coins) comes from the state statute A.R.S. § 42‑5061 (Retail classification; definitions). That statute defines “precious metal bullion” and “monetized bullion” and states that their sale to the “ultimate consumer” is exempt from the state’s transaction privilege tax (the functional equivalent of sales tax).
- Additionally, the state passed House Bill 2014 (HB 2014) which was signed into law in 2017. HB 2014 removed state-level capital gains / income taxation on “specie” (i.e. precious-metal coins) when they are exchanged as legal tender. That makes gold and silver coins treated more like “money” under Arizona law, for tax purposes. The effective date for HB 2014 was August 9, 2017.
